Drug charges: Bronx driver faces possession charges and more

Criminal charges or accusations after an encounter with a law enforcement officer is a frightening experience for anyone. An arrest is a serious matter, and seeking legal counsel as soon as possible might prevent a conviction. A 26-year-old Bronx man was arrested recently, and he now faces drug charges along with other misdemeanor and felony charges.

Whenever a person is arrested for possession of controlled substances in New York, there will be questions about whether law enforcement had adequately obtained search warrants. This question will likely also be asked after the recent arrest of a 30-year-old Queens man. He is now facing various drug charges, and it is expected that more charges related to parole violation might follow.

Drug charges: Defense strategy choice needs careful consideration

Any person facing criminal charges in New York will likely explore defense options. When it comes to drug charges for possession, several defense strategies are available for those who do not plead guilty. A defendant might claim that officers violated his or her Fourth Amendment rights during the search and seizure procedure if the seized drugs were not in plain sight but obtained without consent. Denying ownership of the drugs might be a viable defense if there were others present at the time when police found the drugs.

It is essential for New York residents to know and understand their legal rights whenever they are suspected of or accused of criminal conduct. For example, what is said and done at the time of an arrest on drug charges could be vital when the case goes to court. Suspects must remember that criminal convictions are based on proof beyond a reasonable doubt, and until the prosecution can establish that, the accused individuals will remain innocent in the eyes of the law.

New York cab driver faces drug charges

A New York City cab driver was arrested and is facing drug charges. A federal drug agent apparently stopped the driver after receiving a tip about a scheduled drug transaction to take place over the weekend. Law enforcement authorities approached the parked cab and ordered the driver out of the car. The officers proceeded to search the vehicle and allegedly found a bag with 3.3 pounds of crystal methamphetamine in the spare tire area of the trunk. The driver was then arrested, charged, and held on $1 million bail in a local jail. He may even be deported to his birthplace, the Dominican Republic.

Former New York Yankee faces drug trafficking charges

Drug trafficking or drug distribution often results in more serious consequences than drug possession alone. Any drug arrest, however, can lead to significant jail time, depending on the type of drugs, quantity, circumstances and criminal history of the accused. Former MLB all-star, Esteban Loaiza, was recently arrested on suspicion of drug trafficking.

How can our attorneys help fight against drug charges?

If one faces drug charges, like possession or distribution of an illegal substance in New York, one could face years in prison, if convicted. The severity of the consequences will often depend on the quantity, the type of drugs and what one intended to do with those drugs. Prosecutors will do everything in their power to get the harshest sentence possible, even if the accused did not do the crime.
