Going to the doctor can be a nerve-wracking experience for many people. No matter how complicated or minor a procedure may be, there are no guarantees that a surgery or medical treatment will go exactly according to plan. However, doctors and nurses are expected to provide a standard level of care so that patients are not needlessly and recklessly injured further during a visit to the doctor. If they fail to do this, people can become victims of medical malpractice.
While mistakes cannot always be prevented, there are plenty of errors that should not happen and would not happen unless a doctor has been negligent. One of these errors is a birth injury. During the delivery of a baby, mothers and fathers can be devastated to learn that a nurse or obstetrician has made a mistake and their baby is the one who will have to suffer for the error.
For example, when doctors and nurses in the delivery room fail to notice that a baby is in distress during the birthing process, the result is often that a baby will not get enough oxygen for that amount of time. This can often cause a baby to be born with cerebral palsy.
Recently, a New York family filed a lawsuit against a hospital for this very type of medical malpractice. According to reports, during the delivery of their daughter, a number of mistakes were made by hospital staff and their baby was deprived of oxygen. She was born with cerebral palsy and cannot swallow, write, speak or walk without the help of others.
A jury heard the case and ended up awarding the family $130 million for the damages that were done as well as the extensive and ongoing care that the little girl will require. The award is said to be the highest ever recorded in the state of New York.
