Negotiating a plea deal may lead to a less serious sentence

Despite what you may have seen on television, a majority of criminal cases are resolved without going to trial. Generally, prosecutors and defense attorneys will work together to negotiate a deal based on the circumstances surrounding the alleged crime and the amount of evidence the prosecutor has against the defendant.

When both parties agree to work out a deal, the prosecutor will likely go in to the plea negotiation process with the goal of getting a guilty plea of some kind. This often means that they will agree to let the defendant to plead guilty to a less serious charge.

However, in some cases, the prosecutor will have a great deal of evidence against the defendant. In such cases, the defendant may plead guilty to the original charges, but receive less serious penalties than he would have if his case had gone to trial and he was found guilty by a jury.

It can be difficult for people facing criminal charges to know whether to work out a plea deal or defend themselves at trial. An experienced criminal defense attorney will have dealt with many similar cases and can advise you on what to do after evaluating your case. Your attorney will discuss your case with the prosecutor and once they come to an agreement, your attorney will bring you the deal on the table. It will then be your decision whether to accept the deal. Your attorney will likely give you their opinion as to whether the deal is fair and reasonable, or whether you would be better off going to trial and taking your chances with the jury.
